Key takeaways

  • We track how each state government governs its own use of AI, the rules that shape what agencies can buy and how. As of November 1, 2026, this tracker lists 30 executive orders, 24 laws and 83 agency policies and guidance documents.
  • 19 jurisdictions (including DC) have AI executive orders or a mayor's order, and 18 states have enacted laws on state government AI use, inventories, impact assessments or AI councils.
  • Procurement is becoming explicit: California's 2026 order on trusted AI procurement, Oregon's September 2026 order on AI procurement standards and Maryland's AI Governance Act all affect how agencies buy AI.
  • For AI vendors, expect questions about data use, security, human review, inventories and risk assessments before a contract, and check the state's IT policy first.

Agency policies and guidance

What this means for companies selling AI to government

  • Start with the IT policy. In most states the central IT agency's AI policy or standard sets the rules agencies follow, including which tools need approval.
  • Expect governance paperwork. Inventories, risk or impact assessments, data handling terms and human review requirements are common, and several laws (for example in Connecticut, Maryland and California) require them.
  • Watch procurement standards. California, Oregon and Washington have issued AI procurement orders or guidelines. Build answers to their questions into your proposals.
  • Find the AI office. 23 states have a named AI office, council, task force or center of excellence. These groups shape priorities and often publish roadmaps worth reading before outreach.
  • Remember local government. Cities, counties and school districts often set their own AI rules, which may differ from the state's.

How we built this tracker

We reviewed official state sources (governors' offices, legislatures and state IT agencies) and GovTech's compilation of state and local AI guidance, and linked each item to its official document wherever one was available. We include executive orders, enacted laws and agency-level policies, standards or guidance that govern state government's own use of AI. Bills that haven't been enacted aren't listed. We didn't find a statewide AI executive order, law or policy for Alaska or Arkansas or New Mexico. Spot an error or a new document? Let us know at sales@kensingtonsalesgroup.com.

How KSG helps AI and technology vendors

Kensington Sales Group helps technology companies reach the state and local leaders who decide how AI gets adopted: CIOs, chief data officers, AI councils and program leaders. Our SDRs research each agency's priorities, call the decision-makers and book meetings for your sales team. See our state and local government work.
